Denise Richards and Aaron Phypers have been ordered to vacate the Los Angeles home they co-leased after the landlord claimed they hadn’t paid rent since February.
On Friday, Dec. 26, the Superior Court of Los Angeles granted John Karan repossession of his Calabasas, Calif., property, which he first rented to the celebrity couple in 2020, according to court documents.
The initial complaint, filed by Karan’s attorney, Phoenix Thotta, on Nov. 7, claims Richards, 54, and Phypers, 53, were issued a three-day notice to pay rent or quit the terms of their lease on Aug. 29. Attached in the notice was a chart outlining seven months of allegedly unpaid rent totaling $84,000.

According to the terms of the lease included in the complaint, the couple agreed to pay $400 a day, or $12,000 a month, for the six-bedroom, five-bathroom home. The residence housed the couple, their daughter Eloise, and Richards’ daughters Sami and Lola Rose, whom she shares with ex Charlie Sheen.
After both defendants failed to respond in a timely manner, the court ruled in favor of Karan by default. However, he was only granted possession of the property and Richards and Phypers were not ordered to pay the $84,000.
In a statement shared with PEOPLE, Thottam called the judgement a “routine unlawful detainer proceeding” that “affirms Mr. Karan’s legal right to possession of his property.”

The Calabasas home has been at the center of the couple's contentious divorce proceedings. In August, Richards requested a court order directing Phypers and his family to leave the property, where he lived with his brothers and parents at the time. Richards claimed that although she and Phypers are both named on the lease, she moved out two years ago, believing that Phypers' family would be living there only temporarily.
The filing, obtained by PEOPLE, included photos allegedly showing the state of the home when she visited it on Aug. 3 to retrieve some of her belongings. Richards alleged, "Aaron and his parents and brother have severely damaged the [property] and left the house in a state of disarray."
On Sept. 13, a judge granted Richards access to the couple's residence to "retrieve her mother's and her own personal property, including the dogs," while Phypers was required to remain 100 yards away from the home, pursuant to a temporary restraining order issued in July.
Phypers first filed for divorce on July 7, citing “irreconcilable differences” as the reason for the split, according to documents obtained by PEOPLE. On July 19, Phypers claimed in an interview with TMZ that Richards cheated on him with another man at the beginning of the year.

Days after Phypers' divorce filing, Richards accused Phypers — whom she wed in 2018 — of domestic violence and said he “repeatedly abused" her throughout their relationship.
He denied the allegations of physical abuse as "completely false and deeply hurtful" in a previous statement to PEOPLE.
On Friday, Nov. 7, Richards was granted a five-year restraining order against Phypers that's set to expire in 2030, PEOPLE previously reported.
